FicTopia Terms Of Use

1. Introduction

FicTopia (the "Platform") is operated by FicTopia team ("we," "us," or "our"). The Platform offers a creative environment where developers can create and share interactive narrative experiences. By using or accessing the Platform, including mobile applications and related services, you (the "User") agree to be bound by these Terms of Use ("Terms"). Ongoing use of the Platform indicates your acceptance. If you do not agree, you must cease use at once.

2. User Eligibility

2.1 Authorization: Users representing an organization confirm they possess the legal authority to bind that organization.

2.2 Prohibitions: Individuals who have been previously banned or are in violation of any applicable law are not permitted to use the Platform.

2.3 Age Requirement: Users should be a minimum of 13 years of age. We will adhere to local regulations in regions where a higher minimum age is required (such as 16 years under the GDPR).

3. Account Management

3.1 Registration: Users are required to supply correct information during registration and keep it updated in a timely manner.

3.2 Account Termination: We maintain the right to suspend or terminate accounts for breaches of these Terms. Users can delete their accounts via the provided dashboard tools, understanding that associated data will be permanently lost.

3.3 Security: You must inform us without delay if you suspect any unauthorized account access. Account holders are responsible for all activities conducted through their account.

4. License

4.1 Intellectual Property: We retain all exclusive rights to the Platform, including its software, branding, and content.

4.2 Grant: We provide a limited, revocable, non-exclusive, and non-transferable license to access and utilize the Platform exclusively for the purpose of creating, publishing, and engaging with literary works termed "Stories."

4.3 Limitations: Users must not attempt reverse engineering, data scraping, or any unauthorized commercial exploitation.

5. Content Policies

5.1 Ownership of User Content: You maintain ownership of the original literary works, comments, or media (collectively, "User Content") that you submit to the Platform.

5.2 Content Moderation: We reserve the right to remove any content that breaches these Terms or our community standards. Accounts of repeat violators may be terminated.

5.3 Standards: User Content must adhere to the following:

(a) Be entirely original or used under proper authorization;

(b) Not violate any laws or infringe upon third-party rights;

5.4 Licenses:

Granted to FicTopia: A global, royalty-free license to store, copy, modify, and disseminate User Content for the functioning of the Platform.

Granted to Users: A non-exclusive right to access and engage with User Content as permitted by the Platform's features.

6. Payments and Fees

6.1 Subscriptions: Access to certain features may involve fees. Payments are generally non-refundable, unless required by law.

6.2 Payment Processors: All transactions are processed by third-party services compliant with PCI standards (e.g., Stripe, PayPal). We cannot be held responsible for errors caused by these processors.

6.3 Tax Responsibility: Users are accountable for paying any applicable taxes, such as VAT, GST, or sales tax.

7. Prohibited Activities

Users are prohibited from:

Bypassing the Platform's security measures or access controls;

Misrepresenting their identity or participating in harassing behavior;

Introducing malicious software or disrupting the services;

Utilizing automated systems like bots or scrapers without obtaining our consent first.

8. Limitation of Liability

8.1 Liability Cap: Our total liability for any claim under these Terms shall be limited to a maximum of five hundred US dollars (USD 500).

8.2 Excluded Damages: We shall not be liable for any indirect, special, punitive, or consequential damages resulting from the use of the Platform.

9. Disclaimers

9.1 External Links: We are not responsible for the content or availability of any third-party sites or services linked from the Platform.

9.2 Service "As Is": The Platform is offered without any warranties regarding its quality, reliability, or accuracy. We do not warrant that the service will be uninterrupted.

10. Indemnification

You agree to indemnify, defend, and hold FicTopia team from and against any claims, losses, or damages arising from your User Content, misuse of the Platform, or violation of these Terms.

11. Intellectual Property

11.1 DMCA Notices: Claims of copyright infringement should be sent to contact@fictopia.net and must include:

Clear identification of the allegedly infringing material;

Detailed information about the copyright owner;

A statement made under penalty of perjury.

11.2 Counter-Notice: If content is removed due to a DMCA notice, users have the right to submit a counter-notification through the designated channel.

12. Dispute Resolution

12.1 Governing Law: The laws of [State/Country] shall govern these Terms, without regard to its conflict of law provisions.
